This Privacy Policy and our separate Terms of Service (the “Terms of Service”), incorporated into this Privacy Policy, describe how HLE DRONES, LLC ("Company," "we," "us," or "our") collects, uses, and shares your information when you use nuWay AgTrack, our mobile application, and related services (collectively, the "Service").
By using the Service, you agree to the collection, storage, use, and disclosure of your information that you may provide through interaction with the Service as described in this Privacy Policy and the Terms of Service. PLEASE READ THIS PRIVACY POLICY CAREFULLY.
1. Information We Collect
1.1 Account Information
When you create an account, we collect:
Name and email address provided during registration or via your third-party authentication provider
Profile picture if provided by your authentication provider
Authentication credentials managed securely through our authentication provider
Other information you voluntarily provide when creating or updating your account
1.2 Financial and Billing Information
When you purchase a subscription or other paid features, we collect:
Transaction and billing records records of purchases, subscription status, and transaction history
Billing contact information name and billing address associated with your payment method
Payment card and financial account details are collected and processed directly by our third-party payment processor and are not stored by us.
1.3 Operational Data
When you use the Service, you and your organization create and store:
Job records spray dates, status, acreage, notes, and batch completion data
Application records applicator details, equipment used, timestamps, weather conditions at time of application
Client records client/farm names and contact information
Field records field names, acreage, and GPS coordinates
Pesticide and mix records product names, EPA registration numbers, application rates, and ingredients
Sprayer/equipment records equipment names, types, FAA registration numbers, serial numbers, make, and model
Applicator licensing records state pesticide applicator license IDs, control numbers, and expiration dates
Attachments and photos images or files uploaded or captured within nuWay AgTrack in connection with job, field, or equipment records
Field signatures digital signatures captured in connection with job completion or service verification
Team communications messages, comments, and other content exchanged between team members within nuWay AgTrack
Activity and audit logs records of user actions such as status changes, assignments, and updates to job or equipment records
The specific fields listed above are representative and may not be exhaustive. As the Service evolves, we may collect additional fields within these categories to support new features. Material changes to the types of data we collect will be reflected in updates to this Privacy Policy.
1.4 Location Data
We collect your device’s precise location using your device’s built-in location services, which may utilize GPS, WiFi, and Bluetooth signals, only when you actively use features that require it (such as weather retrieval or field mapping).
We do not collect location data in the background. Location access requires your explicit permission and can be revoked at any time through your device settings.
1.5 Organization and Team Data
Organization name and type
Member email addresses, roles, and membership status
Organizational regulatory identifiers and certificate numbers (if provided)
1.6 Device and Usage Information
We automatically collect:
Device information platform (iOS/Android), operating system version, and IP address
App information app version and build number
Error and diagnostic data crash reports, error logs, and performance metrics
Device identifiers including push notification tokens
Derived usage data including inferences or metrics we generate about your use of nuWay AgTrack
Other device or app data automatically generated in connection with your use of nuWay AgTrack
1.7 Feedback and Support Data
When you submit feedback or support requests through nuWay AgTrack, we collect the content of your submission along with your contact information and relevant diagnostic information about your device and app.
2. How We Use Your Information
We use your information to:
Provide the Service store and sync your operational records, manage your account and organization, authenticate your identity, and retrieve third-party data relevant to your operations (such as weather conditions)
Improve the Service analyze error reports, crash data, and usage patterns to fix bugs and improve performance
Communicate with you respond to your feedback, support requests, and notify you of changes to the Service or these policies
Generate aggregated insights create anonymized, aggregated data for analytics and product improvement that does not identify you or your organization
Process transactions manage your subscription, process payments through our third-party payment processor, and maintain records of purchases
Ensure security and integrity detect, investigate, and prevent fraudulent, unauthorized, or illegal activity, and protect the security of the Service and its users
Comply with legal obligations retain and disclose information as required by applicable law, regulation, or legal process, including agricultural recordkeeping requirements
Enforce our agreements resolve disputes, troubleshoot problems, and enforce this Privacy Policy and our Terms of Service
As otherwise described at the point of collection or with your consent for any other purpose disclosed to you when information is collected or for which you have provided consent
3. How We Share Your Information
3.1 We Do Not Sell Your Data
We do not sell, rent, or trade your personal information to any third party for marketing or advertising purposes.
3.2 Service Providers
We share information with third-party service providers that help us operate the Service. These providers fall into the following categories:
Cloud hosting and database providers: account data, operational records
Data caching providers: cached operational data
Weather data providers: date, time, and location you request weather data for
Authentication providers: essential user identification and authentication data
Error tracking and diagnostics providers: device info, error logs, feedback
Customer support providers: support conversation content, email
These providers are contractually obligated to use your data only for the purposes of providing their services to us.
3.3 Within Your Organization
All operational data you create is visible to other members of your organization, according to the role-based permissions set by your organization's owner and administrators.
3.4 Legal Requirements
We may disclose your information if required to do so by law or in response to valid legal process, including:
Subpoenas, court orders, or other legal demands
Requests from law enforcement or regulatory agencies (e.g., EPA, FAA, state agricultural departments)
We will make reasonable efforts to notify you of such requests unless prohibited by law.
3.5 Protection of Rights and Safety
We may disclose your information to enforce our policies, respond to claims that content uploaded to the Service violates the rights of others, or protect the rights, property, or safety of the Company, our users, or the public.
3.6 Affiliates and Related Entities
We may share your information with our parent company, subsidiaries, and affiliated entities for purposes consistent with this Privacy Policy, including to provide and improve the Service, support internal business operations, and fulfill the purposes described in Section 2 (How We Use Your Information). Any affiliated entity that receives your information will be required to handle it in a manner consistent with this Privacy Policy.
3.7 Business Transfers
If the Company is acquired by or merged with another company, or if the Company forms a division or affiliate and transfers thereto the ownership and operation of the Service, your information may be transferred as part of that transaction. In such event, we will endeavor to notify you before your information is transferred and becomes subject to a different privacy policy, using the contact information you have provided.
4. Data Storage and Security
4.1 Where Your Data Is Stored
On your device operational data is stored locally in your device for offline access
In the cloud data is synced to our cloud database for backup and cross-device access
Authentication tokens stored securely on your device using platform-native secure storage
By using the Service, you acknowledge and consent to the transfer, storage, and processing of your information in these locations, and other locations that the Company may utilize, in its discretion, from time to time.
4.2 Security Measures
We implement industry-standard security measures to protect your data, including encryption in transit and at rest, access controls scoped to your organization, and secure credential storage on-device.
While we take reasonable steps to protect your information, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.
5. Data Retention
Active accounts we retain your data for as long as your account is active
Inactive accounts we may delete data after one year of account inactivity
After termination you have a 30-day window to request your data after account termination, after which we may permanently delete it. This window may be waived in cases of termination for fraud, abuse, or illegal activity.
Local data data stored on your device is managed by you and can be cleared by uninstalling nuWay AgTrack
Regulatory retention requirements notwithstanding the foregoing, we will retain pesticide application records, licensing data, and other operational records for the period required by applicable federal and state law, including requirements under FIFRA and applicable state pesticide regulations, regardless of account status
Legal holds and disputes we reserve the right to retain information beyond the periods described above to the extent necessary to establish, exercise, or defend legal claims, respond to regulatory inquiries, or comply with applicable legal obligations
Anonymized and aggregated data data that has been anonymized, aggregated, or otherwise de-identified such that it can no longer reasonably be associated with you or your organization may be retained and used indefinitely for analytics, product improvement, market research, and other legitimate business purposes
Operational and system limitations deletion requests will be processed with respect to active systems and databases. Residual copies of your information may persist in backup, archival, or disaster recovery systems for a limited period until those systems are purged in the ordinary course. Additionally, we may retain certain records containing your information, including transaction records, audit logs, and similar business records, where retention is necessary for legitimate operational or accounting purposes, even following a deletion request
6. Your Rights and Choices
6.1 Data Deletion
You may request deletion of your account and associated data by contacting us at agtrack@nuwayag.com. We will process your request within 30 days.
Note that some data may be retained in organization records after your account is deleted, as organizational data belongs to the organization (see our Terms of Service).
6.2 Location Permissions
You can revoke location access at any time through your device settings. This will prevent location-dependent features from functioning.
6.3 Account Information
You can update your account information through nuWay AgTrack’s settings.
7. Children's Privacy
The Service is not intended for, and is not directed to, anyone under the age of 18. We do not knowingly collect personal information from anyone under 18. Any individual under the age of thirteen (13) must have the consent of a parent or guardian prior to utilizing the Service. If we learn that we have collected information from someone under 18, we will delete that information promptly. If you believe that we have information from or about a child under 18, please contact us via email at agtrack@nuwayag.com.
8. United States Only
The Service is currently intended for use within the United States only, and the Company does not provide the Service or target its marketing or advertising to individuals or companies outside the United States. We make no claims that the Service or any of its content is accessible or appropriate outside of the United States. Access to the Service may not be legal by certain persons or in certain countries. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
9. California Privacy Rights
If you are a California resident, you are afforded certain rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), with respect to your information, including the following:
Right to Know You have the right to request that the Company disclose the categories and specific pieces of information it has collected about you, the categories of sources from which that information was collected, the business or commercial purposes for collecting or sharing that information, and the categories of third parties with whom the Company shares that Information. This includes information collected through your use of the mobile application, including device identifiers, location data, and operational records.
Right to Delete You have the right to request that the Company delete information it has collected from you, subject to certain exceptions, including, but not limited to, information the Company is required to retain for legal or regulatory compliance, fraud prevention, or the resolution of disputes. Please note that certain operational records, including pesticide application records and applicator licensing data, may be subject to mandatory retention requirements under FIFRA and applicable state pesticide laws, and may not be eligible for deletion regardless of such a request. See Section 5 (Data Retention) for additional details.
Right to Correct You have the right to request that the Company correct inaccurate information it maintains about you.
Right to Opt-Out of Sale or Sharing You have the right to opt out of the sale or sharing of your information for cross-context behavioral advertising purposes. The Company does not currently sell or share your personal information for cross-context behavioral advertising purposes; however, this right is available to you should our practices change, and we will provide notice of any such change in accordance with applicable law.
Right to Limit Use of Sensitive Information To the extent the Company collects sensitive information as defined under the CCPA, you have the right to limit its use and disclosure to purposes necessary to perform the Service. Sensitive information collected through the Service may include precise geolocation data, professional and employment-related information such as applicator licensing records, and other information that may constitute sensitive personal information under the CCPA.
Right to Non-Discrimination ### You have the right not to receive discriminatory treatment for exercising any of your rights under the CCPA.
You may submit a request to exercise any of the above rights by contacting us using the Contact Us information below. We will respond to verified requests within forty-five (45) days, with the possibility of a single forty-five (45)-day extension where reasonably necessary. We are required to verify your identity before fulfilling any request and may ask you to provide additional information for that purpose. You may designate an authorized agent to make a request on your behalf, provided that the agent provides written proof of your authorization and we are able to verify your identity directly with you, independent of the agent. We reserve the right to deny a request from an agent who does not submit proof of authorization, or where we are unable to verify your identity as the consumer on whose behalf the request is made.
California's "Shine the Light" law (Civil Code Section 1798.83) separately permits California residents to request information regarding the disclosure of their information to third parties for direct marketing purposes during the preceding calendar year. 10. Governing Law; Venue
This Privacy Policy is governed by the laws of the State of Ohio, without regard to its conflict of laws provisions. Any dispute, claim or other action taken by you must be filed in the courts located in Holmes County, Ohio, United States. You irrevocably consent to this venue. Any cause of action you may have with respect to this Privacy Policy or the Service must be commenced within one (1) year after the claim or cause of action arose, or it will be barred.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes through an in-app notice and update the "Last Updated" date at the top of this Privacy Policy. Material changes may require your re-acceptance before you can continue using the Service. Your continued use of the Service after such amendments constitutes your acknowledgement of the amended terms of this Privacy Policy and your agreement to be bound by the amended terms of this Privacy Policy.
